Freehold Condos for Sale in Phuket
A condominium unit is the only kind of Thai property a foreigner can own outright, in their own name, on a freehold title. This page gathers the condos our agents list as freehold, with figures computed from the live listings. Whether a given unit can be registered in a foreign name still depends on the building’s foreign quota at the time of transfer.

How foreign freehold works
Under the Condominium Act, foreigners together may own up to 49% of the total floor area of all units in a registered condominium building — the cap is on floor area, not on the number of units. The purchase money must be transferred into Thailand in foreign currency, and the receiving bank issues the foreign-exchange certificate the Land Office asks for at transfer. Our guide to the 49% foreign quota explains each step.
Once the foreign quota of a building is used up, the remaining units can only be bought by Thai buyers or held by a foreigner under a registered lease of up to 30 years. A freehold title held through a Thai nominee is not an alternative: it is illegal, as our guide on Thai company and nominee risks explains.
What to check before you reserve
Ask the seller for a recent letter from the building’s juristic person confirming the foreign quota still available, a copy of the unit’s title deed (Or Chor) and a statement showing that common-area fees and the sinking fund are paid up. For a resale, check that the seller can transfer freehold — some units were bought under a lease or through a company. A due diligence checklist and the transfer costs and taxes are in our guides.
Freehold units usually sell at a premium over leasehold units in the same building. If you are weighing both, our guide to leasehold vs freehold compares what each title gives you.
